Eligibility Criteria

Primary Criteria for Subclass 602 Applicants

To be eligible for a Subclass 602 visa, applicants must meet the primary criteria outlined in the visa’s regulations. These include:

1. Seeking Medical Treatment:
   • Applicants must be coming to Australia for medical treatment (other than for surrogate motherhood) and have arrangements in place to undergo the treatment. This may also apply to organ transplant recipients or organ donors.
2. Free from Public Health Threats:
   • Applicants must not have any medical conditions that pose a risk to public health or safety in Australia.
3. Financial Requirements:
   • The applicant must have sufficient financial arrangements in place to cover the cost of medical treatment, living expenses, and the expenses of any accompanying person. They must also provide proof that these costs will not place a financial burden on Australian government services.
4. No Financial Burden on Australian Authorities:
   • Evidence must be provided that the applicant or their sponsor has secured financial arrangements that will not result in a charge to the Commonwealth, State, Territory, or public authority in Australia.
5. Genuine Intentions:
   • The applicant must genuinely intend to stay in Australia temporarily for the intended medical purposes, with intentions to depart once treatment or related purposes are completed.

Secondary Criteria for Family Members

For family members of an applicant who satisfies the primary criteria, additional secondary criteria apply, such as:

1. Public Interest Criteria:
   • The applicant must satisfy public interest criteria, including health and security requirements.
2. Financial Hardship:
   • The family member must demonstrate they are in financial hardship and show they are not likely to become a charge on the Australian government.
3. Compelling Personal Reasons:
   • The applicant must have compelling personal reasons for staying in Australia.
