Subclass 802 – Child Visa

Eligibility Criteria

1. 1. At the time of application:
   • The applicant must be a dependent child of an Australian citizen, permanent visa holder, or eligible New Zealand citizen.
   • The applicant must be under 18 years of age , unless they meet the special criteria (e.g., adopted child or dependent child within a family unit).
   • The child’s application can be supported by a letter of support from a State or Territory government welfare authority in cases involving child protection or welfare concerns.

   • The applicant must continue to satisfy the criteria for being a dependent child.
   • They must also meet health and character requirements (public interest criteria 4001, 4002, 4003, etc.).
   • If over 18, the applicant must not have had a spouse, de facto partner, or be engaged to be married, and must be participating in full-time study or vocational training.

Secondary Applicant Requirements

For family members included in the application:

• Secondary applicants must be a part of the same family unit as the primary applicant.
• Secondary applicants must satisfy the health and character requirements and meet the secondary criteria laid out in the visa regulations.
• If a State or Territory government welfare authority supports the primary applicant, secondary applicants are eligible for visa approval based on specific criteria.

Application Process

• Prepare Documents: Gather necessary documents including proof of dependency, identity, and any relevant child welfare documentation.
• Submit Application: Submit the application along with required documents to the Department of Home Affairs.
• Health and Character Checks: Applicants and family members must undergo medical examinations and provide police clearances.
• Wait for Decision: The Department of Home Affairs processes the application. If needed, a letter of support from a State or Territory government welfare authority may be included in the application
• Visa Grant: If the application is approved, the child will be granted permanent residency under the Subclass 802 visa.

Visa Conditions

• Permanent residency status is granted to the child, with the ability to travel and re-enter Australia within five years from the visa grant.
• The visa allows the holder to stay in Australia indefinitely, but they may need to apply for a Resident Return Visa to re-enter Australia after the five-year period.
